1. Scope and parties

These terms apply to services provided by Nohexevo GmbH, Lindengasse 14, 1070 Wien (Nohexevo recording studio), to clients booking recording, mixing, mastering, band sessions or podcast production.

Your own terms apply only if we accept them in writing. Consumers are natural persons acting mainly outside their trade or profession; all other clients are business customers.

The contract consists of the accepted quote, these terms and — when you supply third-party personal data — the data processing agreement. The privacy policy is informational and does not amend the contract.

2. Definitions

TermMeaning
QuoteWritten description of service, date, price and payment (email is sufficient).
SessionReserved studio time including an engineer when agreed.
Offline workMixing, mastering or editing without your presence in the studio.
Deposit30% of the agreed gross price to hold the slot.
Business dayMonday to Friday except public holidays in Vienna.

3. Pre-contract information

Before booking, the site and your quote describe essential service features, prices, dates, our identity and contact details, and statutory rights. Service pages explain workflow and show guide prices such as €118 for vocal recording or €245 for mixing per track — only the quote binds.

See FAQ or Contact for questions.

4. Quotes, acceptance and booking

We usually send a quote within 2 business days after your enquiry. Validity is stated on the quote; if none is given, it expires 30 days after sending.

A slot is confirmed only after written acceptance and receipt of the deposit. Until then, the time may be offered elsewhere. For distance contracts we confirm on a durable medium (email) with the key details.

5. Prices and VAT

Prices on the site and in quotes are in euros, gross including 20% VAT unless marked net. Net amounts for businesses may appear as €98.33 or similar in the quote.

Overtime beyond the booked block is charged only with your prior consent, pro rata at the hourly rate in the quote. Add-ons (stem packs, EP bundles, edit hours) only when listed in the quote or ordered in writing.

6. Deposit, payment and default

A 30% deposit is due to reserve the date and is credited to the total. Balance: typically on the session day for attended work; for offline delivery before release of final files unless agreed otherwise.

Business clients pay within 14 days of invoice date. Statutory default interest and recovery costs may apply. Until full payment we may withhold final exports; working files follow article 11.

7. Reschedule and cancellation by you

Time before sessionEffect
More than 7 daysFree reschedule or cancel; deposit refunded within 14 days if cancelled.
Between 7 days and 72 hoursOne reschedule within 3 months; otherwise deposit is retained.
Under 72 hours or no-showDeposit retained except proven force majeure.

Notify us in writing via [email protected]; we confirm phone changes by email. Late arrival shortens the session if the next slot is booked. These rules do not limit mandatory consumer rights.

8. Right of withdrawal (consumers)

Consumers who conclude a distance or off-premises contract may withdraw within 14 days of conclusion where Austrian distance-selling rules apply.

If you expressly ask us to start before the period ends, you pay a fair share for work already done if you withdraw. The right may not apply once the service is fully performed with your express prior consent and acknowledgement that the right expires, or for clearly customised work.

Send withdrawal to Nohexevo GmbH, Lindengasse 14, 1070 Wien, or [email protected]. Refunds within 14 days via the same payment method unless agreed otherwise.

9. Cancellation by the studio

If we must cancel (equipment failure, staff illness, force majeure), we notify you promptly and offer new dates. If none suit you, we refund amounts paid for undelivered work within 14 days. We do not swap the booked engineer without your consent.

10. Studio conduct

Hours: Tuesday–Saturday 10:00–22:00; closed Monday and Sunday. Evening sessions by appointment.. The live room (about 38 m²) suits up to 7 people at once; 2 iso booths are available.

Minimum age 16; minors need written consent from a legal guardian who books and pays. No smoking or vaping indoors. Treat gear and rooms carefully and follow engineer instructions. We may stop unsafe sessions; payment may still be due if the client caused the risk. Gear you bring stays under your responsibility.

We keep listening levels moderate and provide breaks and hearing protection. See band recording, podcast production and mastering for service details.

11. Files, delivery and archiving

Unless agreed otherwise, we deliver bounces or masters as 24-bit WAV via secure download or your drive. Offline deadlines start when complete, usable source files arrive.

We keep session and project files for 12 months after the last relevant service, then delete unless a longer period is agreed in writing. Back up your copies within that window. Tips on stems: deliver stems for mix.

12. Revision rounds

Mixing and mastering include 2 bundled revision rounds (one batch of notes per round) unless the quote says otherwise. Further rounds or a new artistic direction after approval need a new quote. Attended sessions allow real-time feedback.

13. Intellectual property

Your works. Songs, lyrics and samples remain yours or your rights holders'. You warrant necessary rights and handle collecting-society filings. Nohexevo claims no copyright in your compositions.

Phonogram producer. Whoever initiates the first fixation is the producer in the copyright sense. When you commission and pay for recording, that is normally you. Any producer rights that could vest in us transfer to you upon full payment.

Performers. Recording and exploiting performances need performer consent; obtain it for musicians, singers and speakers you bring.

Artificial intelligence. We do not use your recordings to train AI systems and create no voice clones without the person's explicit written consent.

References. We name your project as a reference only with your written OK.

14. Liability

We work to professional audio standards; artistic outcome also depends on your preparation and choices and cannot be guaranteed. Liability for intent and gross negligence is unlimited; for slight negligence only for foreseeable damage to life, body, health or essential contractual duties, capped at typical foreseeable loss.

For business clients, indirect loss and lost profit are excluded except intent or gross negligence; total liability per job is capped at the gross quote price where permitted. Consumer rights stay intact. Website liability limits: disclaimer.

15. Force majeure

Neither party is liable for failure caused by unforeseeable, unavoidable events beyond reasonable control. The affected party informs the other promptly. Sessions move to agreed dates; if disruption lasts over 28 days or no date works, either party may terminate and prepaid undelivered work is refunded.

16. Personal data

We process data under our privacy policy. If you are a business supplying guest or performer data, the data processing agreement applies. Change cookie choices via (stored 182 days, key nhxv_consent_v1).

17. Governing law and jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection in your EU home country remains if you are a consumer living there.

For business disputes, exclusive jurisdiction is Vienna where allowed. Consumers may sue at home when statutory rules allow.

Publisher details: legal notice.

18. Final provisions

If a clause is invalid, the rest stays effective and is replaced by the closest valid rule. Changes apply to new contracts from 15 October 2026; ongoing jobs keep the terms accepted with the quote. The German version is legally authoritative.
